The Third sector reformation has amended the legislation of the social enterprise, body over which this contribution is focused, looking, particularly, at the relationship between non-profit organizations and the pursuit of a business activity, referring especially to the new “Third sector Code” and the enforceability of the commercial entrepreneur’s body of rules. In fact, the boundary between non-profit organizations and societies is increasingly more tenuous, also because of the introduction of the benefit corporations, concerning themselves the combination between the pur- suit of a business activity and social utility purposes.
