The book purports to provide a primer to constitutional argumentation. It contains three parts. Part one ("Concepts") offers an analysis, in turn, of the key concepts "judicial creation of law", "judicial discretion", and "interpretive correctness". Part two ("Theories and Ideologies") copes with some theoretical and ideological outlooks making up the philosophical background of the practice of constitutional argumentation in present day constitutional democracy (positivism, principle-constitutionalism, garantist-constitutionalism, anti-positivism, textualism). Part three ("Instruments") copes with balancing, four types of constitutional argumentattion, and (among others) the notions of classificatory, interpretive, integration, and resolution codes.

Abstract
The book purports to provide a primer to constitutional argumentation. It contains three parts. Part one ("Concepts") offers an analysis, in turn, of the key concepts "judicial creation of law", "judicial discretion", and "interpretive correctness". Part two ("Theories and Ideologies") copes with some theoretical and ideological outlooks making up the philosophical background of the practice of constitutional argumentation in present day constitutional democracy (positivism, principle-constitutionalism, garantist-constitutionalism, anti-positivism, textualism). Part three ("Instruments") copes with balancing, four types of constitutional argumentattion, and (among others) the notions of classificatory, interpretive, integration, and resolution codes.I documenti in IRIS sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
