The objective of this article is to reflect on the Genoese statuta civilia of the modern age which presuppose gender difference. After having identified the statuta civilia aimed at supporting or circumscribing the female agency, the norms relating to contractual capacity are analyzed with reference also to the doctrine. The norms and the practice seem to suggest openings towards the contractual capacity of Genoese women, despite the few freedoms and rights granted to them in that historical period.
