Since the early years of this millennium, scientific advances in the field of technology have opened up new scenarios that have raised questions about liability for the use of technological and robotic devices and the use of artificial intelligence (AI) in the field of protecting vulnerable people (the sick, people with disabilities, the elderly, people living in poverty). The European legislator has not yet laid down rules on this matter, which are now essential for identifying the criteria for attributing liability in the event of damage caused by new technologies and establishing rules for compensation. and prevention, currently derived from the provisions in force in each national legal system. The study analyses European legislative proposals, assessing their possible repercussions on the domestic legal system with a view to outlining a set of rules to protect people living in a Smart City, proposing solutions that promote technological development without violating fundamental rights. The study also examines the role of the European Court of Justice in interpreting the rules of the European Union and the role of national courts in applying them.
