The article has been elaborated within the scientific activity carried out by the Research Unit of the University of Genoa for the National Research Project (PRIN 2020) titled «Rethinking the Principle of Unlimited Liability in the Context of the Current Legal Framework: The Pioneering Role of Maritime, Air and Transportation Law as Forerunner of the New Rules and Models of Limitation of Liability and Claims?» Prot. 20208JFB98_004, CUP G23C22000570001. The article focuses on the regime of limitation of the hotel-keeper’s liability according to Italian Law that has implemented the 1962 Convention on the liability of hotel-keepers concerning the property of their guests. Accommodation is a service included in the travel package. Cruise contract is a sui generis travel package. According to the Italian tourism code, insofar as international conventions binding Italy and European Union limit the extent of or the conditions under which compensation is to be paid by a provider carrying out a travel service which is part of a package, the same limitations apply to the organiser. The Italian Civil Code establishes that the hotel-keeper is liable for any damage or destruction, or loss of property brought to the hotel by any guest who stays at the hotel and has sleeping accommodation put at his disposal. The amount of the compensation of damages suffered by the client is limited to one hundred times the daily charge for the room. The parameter for calculating the limitation of compensation is the daily charge for the room. This parameter avoids inflationary issues and makes accommodation’s service proportionate to risk. The hotel-keeper unilaterally fixes the daily charge for the room. He does not establish the limitation of compensation. This limitation is a legal effect that reflects the pre-eminent interest to promote hotel activity and similar activities, avoiding costs to prevent any damages to hotel-keeper’s client.

L'articolo è focalizzato sul regime di limitazione dell’albergatore secondo la legge italiana che ha reso esecutiva la Convenzione del 1962 sulla responsabilità degli albergatori per le cose portate dai clienti in albergo. L’alloggio è un servizio formante il pacchetto turistico. Il contratto di crociera turistica è un contratto di pacchetto turistico sui generis. Nella misura in cui convenzioni internazionali vincolanti l'Unione limitano la portata del risarcimento o le condizioni a cui è dovuto da un fornitore che presta un servizio turistico incluso in un pacchetto turistico, secondo il codice del turismo italiano, all'organizzatore si applicano le stesse limitazioni. Il Codice civile italiano stabilisce che l’albergatore è responsabile per il deterioramento, la distruzione e la sottrazione delle cose portate in albergo dal cliente che soggiorna nell’albergo e dispone di un alloggio. L’ammontare del risarcimento del danno subito dal cliente è limitato a cento volte il prezzo della locazione dell’alloggio. Il parametro di calcolo della limitazione risarcitoria è il prezzo giornaliero della camera d’albergo. Tale parametro evita l’insorgere della problematica dell’inflazione e rende il servizio alberghiero proporzionato al rischio. L’albergatore fissa unilateralmente il prezzo giornaliero dell’alloggio. Egli non determina la limitazione risarcitoria che è un effetto di legge. Tale effetto riflette l’interesse preminente di promuovere l’attività alberghiera e altre attività simili, evitando costi per prevenire danni all’ospite dell’albergatore.
