Le decisiones della Rota di Genova: genesi e contenuti dell’opera

This essay examines the formation and role of the Decisiones of the Genoese Civil Rota in the sixteenth century, showing how the tribunal integrated common law and mercantile customs into a stylus curiae endowed with autonomous normative authority. The decisions reflect the economic centrality of the Republic—active in maritime trade, international fairs, and finance—and address key institutions such as bills of exchange, accounting practices, bankruptcy, and insurance. Through the evidentiary use of merchants’ writings, the emphasis on good faith, and the adaptation of Roman-law categories to commercial needs, the Rota contributed to shaping modern commercial law and exerted significant influence beyond the Genoese context.

Il saggio ricostruisce la formazione e il ruolo delle Decisiones della Rota civile di Genova nel XVI secolo, mostrando come il tribunale abbia integrato diritto comune e consuetudini mercantili in uno stylus curiae dotato di autonoma forza normativa. Le sentenze riflettono la centralità economica della Repubblica — attiva nei traffici marittimi, nelle fiere e nella finanza internazionale — e affrontano istituti quali cambiali, contabilità, fallimenti e assicurazioni. Attraverso l’uso probatorio delle scritture mercantili, la valorizzazione della buona fede e l’adattamento delle categorie romanistiche, la Rota contribuisce alla definizione del diritto commerciale moderno, esercitando un’influenza significativa oltre l’ambito genovese.
