The article examines the formation and evolution of the jurisdictional spaces of mercantile justice between the Middle Ages and the early modern period, highlighting how ius mercatorum emerged as a special legal order grounded in equity, procedural speed, and corporative autonomy. Through an analysis of cities, guilds, markets, and especially fairs, it illustrates the construction of protected environments endowed with privileges and dedicated jurisdictions, tailored to the needs of commercial exchange. The study also reconstructs the increasing involvement of political authorities, which from the late medieval period to the Napoleonic era progressively integrated or replaced mercantile courts with state‑run specialized tribunals. The resulting picture is one of a dynamic system in which commercial justice reflects shifting relationships among economic practice, professional autonomy, and public power.
L’articolo analizza la formazione e l’evoluzione degli spazi giurisdizionali propri della giustizia mercantile tra Medioevo ed Età moderna, evidenziando come lo ius mercatorum si sviluppi quale diritto speciale fondato su equità, rapidità procedurale e autonomia corporativa. Attraverso l’esame delle città, delle corporazioni, dei mercati e soprattutto delle fiere, si mostra la costruzione di luoghi protetti dotati di privilegi e giurisdizioni proprie, funzionali alle esigenze del commercio. L’indagine ricostruisce inoltre il progressivo intervento del potere politico, che dal tardo Medioevo all’età napoleonica tende a integrare o sostituire le corti mercantili con tribunali statali specializzati. Ne emerge un quadro dinamico in cui la giustizia commerciale riflette il mutare dei rapporti tra economia, autonomia professionale e potere pubblico.
