Previdenza e dinamiche intergenerazionali nella prospettiva costituzionale: une esquisse

Social security schemes are a ground for weighing the various values at stake, in a perspective where the protection of vested rights on the one hand, and intergenerational solidarity on the other hand, are the pillars guaranteeing some stability to a system whose architecture becomes increasingly complex. In the last years, a gradual transition is being recorded from the social security system to the welfare system, which of course causes tensions and pressures of various kinds and magnitude, which are not easy to manage. It is, therefore, in such a context that the Constitutional Court is called to balance subjective situations underlying social security benefits on the one hand, and intergenerational solidarity on the other hand, by adopting argumentation strategies and decision-making techniques allowing ensuring that all interests at stake are somehow taken into account.
