This thesis analyzes the phenomenon of normative hypertrophy. It starts from the observation of an asymmetry between underregulated areas and others characterized by an excess of regulation, and examines how the latter affects the coherence, intelligibility, and cognoscibility of the law. From a conceptual perspective, the research proposes a systematic reconstruction of the notion of normative hypertrophy, distinguishing it from related categories such as legislative inflation, and identifies its structural conditions: diversity of sources, constant amendments, and complexity of normative provisions. It also analyzes its effects on the functioning of legal systems, particularly in relation to phenomena of redundancy and antinomies, as well as its impact on the knowledge of the law, highlighting how the increase in normative complexity raises the cognitive burden on addressees and undermines principles such as legal certainty and predictability. Overall, the thesis argues for the need to conceptualize normative hypertrophy as an autonomous category in order to critically understand the contemporary functioning of the law.

La presente tesis analiza el fenómeno de la hipertrofia normativa. Parte de la constatación de una asimetría entre ámbitos insuficientemente regulados y otros caracterizados por un exceso de regulación, y examina cómo este último incide en la coherencia, inteligibilidad y cognoscibilidad del Derecho. Desde una perspectiva conceptual, la investigación propone una reconstrucción sistemática de la noción de hipertrofia normativa, distinguiéndola de categorías afines como la inflación legislativa, e identifica sus presupuestos estructurales: diversidad de fuentes, constantes modificaciones y complejidad de los enunciados normativos. Asimismo, se analizan sus efectos sobre el funcionamiento de los sistemas jurídicos, en particular en relación con fenómenos de redundancia y antinomias, así como su impacto en el conocimiento del Derecho, poniendo de relieve cómo el aumento de la complejidad normativa incrementa la carga cognitiva de los destinatarios y compromete principios como la certeza y la previsibilidad jurídicas. En conjunto, se sostiene la necesidad de conceptualizar la hipertrofia normativa como una categoría autónoma para comprender críticamente el funcionamiento contemporáneo del Derecho.
