The article examines the role of AI and digital technologies in pro- moting inclusive Smart Cities, with a particular emphasis on safeguarding the rights and accessibility of elderly and disabled individuals. It examines the legal and ethical challenges posed by technological advancements, such as algorith- mic discrimination and the digital divide, which can exacerbate social inequal- ities. The authors highlight key European and Italian regulations, including the AI Act and the Web Accessibility Directive, aimed at ensuring accessibility and non-discrimination. The study underscores the importance of balancing innova- tion with fundamental rights, advocating for universal design and digital literacy to empower vulnerable groups. By analysing case studies and legislative frame- works, the article proposes strategies to integrate technology into urban planning while safeguarding inclusivity and human dignity.
