The European Court of Human Rights (Affaire Y v. France 2023) addresses the question of whether or not a member state is required to provide that an intersex person can be registered on the birth certificate using a gender other than male/female. The judges decided that states are free to consider whether or not to abandon the binary system thus recognizing a third gender for intersex persons.

Abstract

The European Court of Human Rights (Affaire Y v. France 2023) addresses the question of whether or not a member state is required to provide that an intersex person can be registered on the birth certificate using a gender other than male/female.
