The article justifies that the notion of exception does not allow us to understand or identify an element of the antecedent of the norms or a type of norm. I will argue that the best way to understand how legal theorists use the notion of exception is as a concept that refers to propositions that describe the result of a set of operations of either undermining a norm (determining it to be irrelevant), or overruling a norm (they determine that their noncompliance is justified).

Abstract

The article justifies that the notion of exception does not allow us to understand or identify an element of the antecedent of the norms or a type of norm. I will argue that the best way to understand how legal theorists use the notion of exception is as a concept that refers to propositions that describe the result of a set of operations of either undermining a norm (determining it to be irrelevant), or overruling a norm (they determine that their noncompliance is justified).
