The paper discusses the issue of the legal nature of contractual expert determination (raised within a Supreme Court «ordinanza», n. 7795/2025) and its autonomy vis-à-vis related institutions (arbitration, valuation/arbitrement). The paper favors the solution that emphasizes the sui generis and atypical nature of contractual expert determination, subject, however, to its possible recharacterization where the court identifies the objective elements that would instead align it with valuation or arbitration.
