The work aims at presenting the most relevant takeaways of the decision delivered by the Dutch Court of appeals in the Milieudefensie v. Shell case, and to dwell on some critical aspects such as the requirement of some degree of control over Scope 3 emissions; the correct epistemological reading of the relationships between science and law; possible legislative backlashes following public interest litigation under the focal point of view of legal standing of associations in class actions; and the role of morality and soft law from the private international law standpoint.
