The article addresses the use of artificial intelligence and robotics in the healthcare sector, highlighting the benefits in terms of prevention, diagnosis, and treatment, but also the risks in terms of the protection of fundamental rights. The European legislator has established the importance of human supervision and compliance with safety and security principles in the healthcare sector, as well as recognizing the need to promote the circulation of data for research and patient protection purposes. However, the issue of civil liability for damage caused by AI remains unresolved. Currently, this issue is addressed by the legislation in force in individual countries, but it could be tackled by providing for a different degree of liability depending on the risk transferred to the market, with a view to balancing economic development and the protection of individual rights which is the objective of European regulatory acts

Abstract
