The aim of this lecture is to analyse the questions that have arisen in relation to mooring contracts, the operation of pleasure craft and the insurance of civil liability in pleasure boating under Italian law. The definition, legal classification and discipline of mooring contracts are examined. The distinctive features of contracts for the hire and charter of a pleasure boat compared with contracts for the hire and charter of a merchant ship are also considered. In addition, the compulsory insurance of civil liability in pleasure boating is analysed. The aforementioned issues are examined through the provisions of the Pleasure Craft Code, the Private Insurance Code and the Civil Code, considering Italian doctrine and case law. In conclusion, the main aspects requiring action by the Italian legislator are highlighted.
