Starting from the crisis of representative democracy and the advent of digital technologies, this essay examines the relationship between democracy and cyberspace, especially with regard to the entry of new communication and information technologies into the political arena. This helps to better assess whether these new forms of digital democracy (or e-democracy) are truly capable of enabling greater citizen participation in the political and participatory dimension and of restoring an effective and fruitful integration between the procedures of representative democracy and the typical tools of direct democracy to which new technologies aspire. The paper first analyses the theoretical and doctrinal framework of digital democracy to outline the main lines of development in the application of digital technologies to processes of political participation and collective deliberation. It then reviews some particularly significant concrete experiences of digital democracy within the European and Italian legal systems.
Partendo dalla crisi della democrazia rappresentativa e dall’avvento delle tecnologie digitali, il saggio esamina il rapporto tra democrazia e ciberspazio, specialmente con riferimento all’ingresso nell’arena politica delle nuove tecnologie della comunicazione e dell’informazione, al fine di meglio valutare se queste nuove forme di democrazia digitale (o e-democracy) siano effettivamente in grado di consentire una maggiore partecipazione dei cittadini alla dimensione politico-partecipativa e di riportare a un’effettiva e proficua integrazione tra le procedure della democrazia rappresentativa e gli strumenti tipici della democrazia diretta a cui guardano le nuove tecnologie. Il contributo analizza dapprima il quadro teorico e dottrinale della democrazia digitale per delineare le principali linee di sviluppo dell’applicazione delle tecnologie digitali ai processi di partecipazione politica e di deliberazione collettiva, per poi dare conto di alcune esperienze concrete particolarmente significative di democrazia digitale all’interno degli ordinamenti giuridici europeo e italiano.
