This introduction presents a special issue on the relationship between commons, social movements, and the role of law, based on the papers discussed during the 2024 conference at the University of Genoa. Drawing on experiences developed primarily in the Italian and Spanish contexts, the collected essays address several unresolved theoretical and legal issues in the debate on the commons, including the crisis of the public/private divide, the reconfiguration of property regimes, the role of collective subjectivities, and the ambivalent function of law as both a mechanism of regulation and a potential driver of transformative governance of common resources.
