The article examines the profound transformation of family proceedings in Italy following the Cartabia reform, highlighting the shift from the traditional dispositive model to a system centred on the protection of minors and vulnerable individuals. It explores the expansion of judicial powers, and the redefinition of the lawyer’s role. It also analyses the tension between increasing party autonomy and the growing procedural non-disposability of rights. The paper ultimately questions whether this new model remains a form of differentiated jurisdiction or has become an autonomous procedural system.
