Starting from the regulatory framework of the civil protection system, as outlined in the 2018 Code, this contribution focuses on the recent reforms introduced in the field of planning. In particular, it examines the so-called substitutive power of the Government under Article 5-bis of the so-called “reconstruction” decree (Law Decree No. 3 of 11 January 2023, converted with amendments into Law No. 21 of 10 March 2023). This legal provision provides the Author with an opportunity to offer some systematic reflections on the so-called remedial mechanisms in planning activities.
