The paper examines the principle of transparency of air fares within the European Union and Italian legal frameworks, showing how it constitutes one of the main limits to the freedom of airlines to set fares. In particular, it analyses misleading commercial practices relating to the structure and presentation of fares, with specific reference to the phenomenon of drip pricing and to the online selection of optional services. Particular attention is devoted to differentiated, personalised and “intelligent” fares, with regard to which the implications arising from EU law and recent Italian legislation are explored. In conclusion, the paper highlights that, even in the digital era, fare transparency remains an essential instrument for protecting passengers against the opacity of fare-setting and fare-presentation processes, as well as against the potentially distortive use of algorithms and artificial intelligence.
Lo scritto analizza il principio di trasparenza delle tariffe aeree nell’ordinamento unionale e nazionale, mostrando come esso costituisca uno dei principali limiti alla libertà tariffaria delle compagnie aeree. In particolare, sono esaminate le pratiche commerciali ingannevoli connesse alla struttura e alla presentazione delle tariffe, soffermandosi sul fenomeno del drip pricing e sulle modalità di selezione online dei servizi opzionali. Particolare attenzione è dedicata alle tariffe differenziate, personalizzate e “intelligenti”, rispetto alle quali vengono indagate le implicazioni derivanti dalla normativa unionale e dalla più recente legislazione italiana. In conclusione, il contributo evidenzia come, anche nell’era digitale, la trasparenza tariffaria resti uno strumento essenziale per tutelare i passeggeri contro l’opacità dei processi di determinazione e presentazione delle tariffe aeree e contro l’uso potenzialmente distorsivo di algoritmi e intelligenza artificiale.
